The TMRRW Awards AUS & NZ– Terms and Conditions of Entry
The TMRRW Awards AUS & NZ is owned and operated by Something Studios Pty Ltd a Company ABN: 20619758002 of 19 Parrot Tree Place, Bangalow NSW 2479, Australia
In these Terms and Conditions, any reference to “we” or “us” refers to this company and any of its related companies or persons. In these Terms and Conditions, The TMRRW Awards: AUS & NZ are referred to as “the Awards”.
These are the terms and conditions subject to which we will allow you as individuals, small groups of collaborators, or businesses (“you”) to enter our Awards Competition. By lodging your Entry you agree to be bound by these Terms and Conditions.
1. Rules and Conditions
1.1 All Entries for the Awards must be made online at https://tmrrw.world/awards/anz (“the Website”).
1.2 All Entries must be supplied and conform to rules/submission formats set out on the Website.
1.3 All information in each Entry must be completed with true and accurate information. Any Entry may be rejected on the grounds of false, incomplete or inaccurate information, in which case the Entry Fee will not be refunded.
1.4 The judges reserve the right to re-allocate Entries to a different category that, in their sole discretion, have been entered in an incorrect category.
1.5 The judges also reserve the right to remove Entries where they do not meet the Entry requirements. Where fees have been paid, these Entries will not be refunded as they will have been judged accordingly with the rest.
1.6 Whilst every care will be taken in the storage of Entries, the organisers will not accept responsibility for loss or damage of Entries.
1.7 Any Entries containing illegal and/or offensive material (in the sole discretion of the judges) will be disqualified, and the Entry Fee will not be refunded.
2. Entry Eligibility
2.1 Entry to the Awards is open to all Australian and New Zealand based entrants. The submission must be able to demonstrate that the core team, or the output and impact of the project was realised in Australia or New Zealand.
2.2 Submissions may be from individuals, small groups of collaborators, not-for-profit organisations or businesses.
2.3 Where relevant, Entries may be submitted in more than one category.
3. Entry Fee
3.1 The Entry fee per Category entered is $199.00 AUD per entry + GST. This is a non-refundable fee towards our operating costs. A discount of 25% (percent) per additional category will be applied to Entries submitted for multiple categories. The discount will be applied at checkout.
3.2 Early-bird entries, those submitted before 23:59 30 September 2023, will be charged at the discounted rate of $99.00 AUD per entry + GST.
3.3 A credit card processing fee may apply.
3.4 All Entry fees are non-refundable and non-transferrable.
4. Judging CriteriaAll submissions will be judged on the following criteria:
4.1 Innovation: Recognising Change Makers disrupting the status quo and creating new ways to overcome today’s biggest challenges.
4.2 Impact: Recognising Change Makers creating a meaningful and measurable impact on people and the planet.
4.3 Growth: Recognising early-stage Change Makers demonstrating world-changing potential.
4.4 Excellence: Recognising Change Makers delivering outstanding achievements.
5. Judging Process
5.1 Submissions will be judged across several phases:
(a) Category Shortlist: All valid entries are reviewed and scored, out of 10, for each of the 4 judging criteria, to generate a total score. Judges review and score the shortlisted entries assigned to them for each of the category specific judging criteria. (b) Award Winners: The judges review the finalists for each award and vote to determine the winner. Judges meet to discuss any outstanding decisions, questions or particular points of interest. (c) People’s Choice: Open to the public, the People’s Choice Award is for the entries announced as finalists and is awarded to the single Entry with the most valid public votes across all categories. A valid People’s Choice vote is one that conforms to all minimum requirements outlined on the website. (d) The judges are each given a single vote to cast across the award winning entries to decide the Change Maker Of The Year.
5.2 Winners will be announced on 23 November 2023.
5.3 The Judge’s decision is final and no correspondence will be entered into.
5.4 Judges will not provide feedback or comments on individual entries.
6. Rights Granted and Warranties
6.1 By entering these awards, you give the organisers non-exclusive, perpetual, worldwide and irrevocable right to reproduce, distribute, publish, exhibit, communicate to the public or broadcast any material from your submission, as well as any other materials supplied by you in connection with your submission (e.g. videos, photographs, drawings, etc) (“the Materials”) in all media now known or hereafter devised, including but not limited to The TMRRW Awards website and social media pages, as well as through third party media organisations, Partners and Supporters.
6.2 If you wish to upload a modified/less commercially sensitive version for publishing purposes, please do so as part of your Entry.
6.3 By submitting an Entry, you grant the right to use by us of the name, likeness and/or biography of all parties involved with the submission or other information in connection with The TMRRW Awards.
6.4 You warrant that you have received consent from all employers, principals, agents, clients, collaborators or other third parties listed on your Entry to use their name, likeness, and Project details and materials in association with The TMRRW Awards. If you do not have such consents, you must disclose this on your application form. Failure to obtain these consents may result in rejection of your Entry.
6.5 You acknowledge and agree that you are not entitled to any further payments, fees or consideration of any kind in connection with the use or non-use of the Materials.
6.6 By submitting an Entry, you warrant: (a) that you have full power and authority to abide by these terms and grant all the rights contemplated hereunder; (b) that you own all intellectual property rights in and to the Materials supplied in any application, or in the case where the Materials are owned or controlled by a third party, you have obtained appropriate consents, licenses, and authority from such third party in order to make the grant of rights hereunder and to submit the Entry; (c) that the Materials are: (i) original and do not infringe upon nor violate any intellectual property rights, privacy, publicity, property, proprietary, contractual, or other right of any third party; (ii) are not misleading nor deceptive, and do not contain any material which may be considered offensive or defamatory.
6.7 You agree to indemnify and to keep indemnified, us, The TMRRW Awards and any related companies or persons, and affiliated entities (collectively, “the Indemnified Parties”) against any claims, actions, suits, proceedings, causes of action, costs, losses or demands made against the Indemnified Parties arising out of, directly or indirectly, any breach by you of any warranty, representation or agreement made by you in connection with your Entry, the Materials or otherwise relating to the Awards.
7. Data and Privacy
7.2 When registering your details for the purpose of entering the The TMRRW Awards, you agree to be added to the TMRRW mailing list and may receive marketing or other related communications. You will have the option to opt out and unsubscribe from the TMRRW mailing list at any time.
8. Cancellations, Withdrawal and Change
8.1 We reserve the right to cancel, postpone or move the Awards at our discretion for any reason whatsoever. However, we will notify you promptly if the change relates to a material change in timing. For the avoidance of doubt, such a change shall not entitle you to terminate this Agreement, and these Terms and Conditions will continue to apply.
8.2 We reserve the right to change the Awards’ Judges.
8.3 If you wish to withdraw your Entry, you must email us via the Contact Us link on the Website. Withdrawn Entries will not qualify for a refund of the Entry Fee.
8.4 You agree that we will have no liability under this Agreement, in any way whatsoever and howsoever (whether in contract, tort, or otherwise) arising out of or in connection with respect of any cancellation or postponement of the Awards.
9. Fees and Payment
9.1 Payment of any bank transfer charges are your responsibility.
9.2 All sums payable by you under this Agreement are subject to any applicable tax, levy or similar governmental charge, including Goods and Services Tax (GST) which we shall add at the applicable rate.
9.3 All sums due under this Agreement shall be paid in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
9.4 If you fail to make payment of any sums due, or a payment made by you is later dishonoured for any reason, we reserve the right to cancel your Entry with immediate effect. Such cancellation can include the revocation of any award granted as a result of winning your category of the Awards, and providing that Award that to another Entrant.
10.1 This Deed will be governed by and construed under the laws applicable to the State of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the Courts of that place in respect of any dispute arising under this Deed or relating to its implementation or enforcement.
